What is Personal Injury?
Personal injury law is part of the law of
Torts. A tort is a wrongful act recognized by law as grounds for a
lawsuit. These wrongs, or torts, result in injury or harm which
constitute the basis for a claim by the injured party. A personal
injury claim can be filed for injury or harm suffered by an individual,
either physically or mentally, and it can sometimes include damage
to property. While some Torts are also punishable
under penal law, the primary aim of Tort
law is to provide relief (compensation) for damages

suffered by the injured party. Among the types of
damages an injured party may recover are: pain and suffering, loss
of earnings and reasonable medical expenses. They encompass both
present and future expected losses.
Whether you’ve been injured as a result of
medical malpractice, a
car
accident, a slip and fall, a
dog bite, lead poisoning, a
defective
product, a work injury (see
Types of Cases), you may be entitled to collect substantial
financial compensation for your injuries. You should consult with a
personal injury lawyer as soon as possible. This is important
not only because the |

law gives you a specific time within which to bring
your case (statutes of limitations) but also because the sooner you
retain an attorney the sooner your claim can be investigated. A
lawyer will gather vital facts, have witnesses interviewed and
obtain statements while your accident is still fresh in everyone’s
mind. In personal injury cases it is important to have accurate
accounts of what happened and exactly how the accident occurred.
Delay in contacting a personal injury attorney can work to the
benefit of the insurance company with whom the attorney will have to
deal with.
Personal injury lawyers work
on a “contingency fee” basis. That means you only pay the attorney
if he or she collects money for you. Most personal injury lawyers
offer free consultations to accident victims. |
