Slip and Fall
A "slip and fall" or "trip and fall" is the general
term used for any injury which occurs when someone slips, trips or
falls as a result of a dangerous condition on someone else's
property. It includes falls as a result of snow, ice, or water
accumulation, or a "foreign object", as well as defective conditions
on a sidewalk or walkway, flooring, step or
ground. A fall can also be the result of poor or inadequate
lighting.
If you injure yourself on someone's property due to a
dangerous or hazardous condition, the property owner or business
owner may be liable for your injuries. The law will hold such
owners responsible for dangerous and hazardous conditions on their
property which they either created, knew
about, or should have known about. Some conditions are obvious, such
as a broken step; others are hidden, such as a hole in a floor
covered by a rug. Some hazards may not be apparent, such as a step
which appears normal but is slippery. A
dangerous or hazardous condition can be permanent, such as a broken
or uneven sidewalk, or temporary, such as a liquid spill in a
supermarket aisle. |

As a general rule, a property owner will be considered
to have knowledge of a dangerous or hazardous condition if it is
permanent in nature. If the condition is temporary, such as a liquid
spill in a supermarket, the length of time that the condition
existed is very important. If the spill occurred just before the
injury takes place, the property or business owner may not be liable
for the injury since the condition did not exist for a sufficient
length of time for the owner to have become aware of the condition
or to have done anything about it.
If your injury takes place in a building, store or
someone's place of business, you should immediately report the
incident. Make sure an accident, or "incident", report is made by
the owner, manager or supervisor of the premises. Ask for a copy of
the report or anything prepared by the premises owner or tenant.
As a general rule, it is wise to seek legal advice
immediately after you suspect you’ve been injured as a result of
someone’s negligence, whether it’s

accident, a slip and fall, a
dog bite, lead poisoning, a
defective
product, a work injury or
